Can I sue my doctor for not reading my xrays and listening to my complaints?

He did not listen to me when I told him what my symptoms were. I had 2 sets of xrays and an MRI that should have raised suspicians that I needed surgery. I went to another doctor, but it was too late to fix the problem with my elbow- too much time had elapsed due to the orthopedic doctor’s misdiagnosis. Now I will have to have more invasive surgery. What should I do? I was paying for a yoga instructor’s license. Now it may not be possible due to his negligence and incompetence. What should I do?

    Everyone makes mistakes and instead of getting consumed in a law suit just let it go and move on with your life

    It depends on if he had a radiologist read the x-rays and MRI for him too. If they also missed it then he is in the clear, since he can argue that even the experts at reading the results missed it. Do you have copies or can you get copies of the MRI and xray reports? Depending on what they say you may have a chance to sue or not.

    Personally, I would be thankful I found a good doctor and getting the help I need.

    You can definitly sue the first doctor for malpractice.

    You are free to bring suit against anyone at any time. The question is this: can you win? Contact a lawyer specializing in medical litigation. You will, however, have the burden of proof that you were provided with less than the accepted standard of care in your case (you will be surprised to learn how low this standard is).
    If you prove your case, you can collect damages.
